Rejection of unsolicited e-mails

We herewith object to the use of contact information published in conjunction with the mandatory information to be provided in section „Information Required by Law“ to send us promotional and information material that we have not expressly requested. The operators of this website and its pages reserve the express right to take legal action in the event of the unsolicited sending of promotional information, for instance via SPAM messages.

If you submit inquiries to us via our contact form, the information provided in the contact form as well as any contact information provided therein will be stored by us in order to handle your inquiry and in the event that we have further questions. We will not share this information without your consent.

Hence, the processing of the data entered into the contact form occurs exclusively based on your consent (Art. 6 Sect. 1 lit. a GDPR). You have the right to revoke at any time any consent you have already given us. To do so, all you are required to do is sent us an informal notification via e-mail. This shall be without prejudice to the lawfulness of any data collection that occurred prior to your revocation.

The information you have entered into the contact form shall remain with us until you ask us to eradicate the data, revoke your consent to the archiving of data or if the purpose for which the information is being archived no longer exists (e.g. after we have concluded our response to your inquiry). This shall be without prejudice to any mandatory legal provisions – in particular retention periods.

Request by e-mail, telephone or fax

If you contact us by e-mail, telephone or fax, your request, including all resulting personal data (name, request) will be stored and processed by us for the purpose of processing your request. We do not pass these data on without your consent.

The processing of these data is based on Art. 6 para. 1 lit. b GDPR, if your request is related to the execution of a contract or if it is necessary to carry out pre-contractual measures. In all other cases, the processing is based on your consent (Article 6 (1) a GDPR) and/or on our legitimate interests (Article 6 (1) (f) GDPR), since we have a legitimate interest in the effective processing of requests addressed to us.

The data sent by you to us via contact requests remain with us until you request us to delete, revoke your consent to the storage or the purpose for the data storage lapses (e.g. after completion of your request). Mandatory statutory provisions - in particular statutory retention periods - remain unaffected.

Processing of data (customer and contract data)

We collect, process and use personal data only to the extent necessary for the establishment, content organization or change of the legal relationship (data inventory). These actions are taken on the basis of Art. 6 Sect. 1 lit. b GDPR, which permits the processing of data for the fulfilment of a contract or pre-contractual actions. We collect, process and use personal data concerning the use of our website (usage data) only to the extent that this is necessary to make it possible for users to utilize the services and to bill for them.

The collected customer data shall be eradicated upon completion of the order or the termination of the business relationship. This shall be without prejudice to any statutory retention mandates.

4. Analysis tools and advertising

Matomo

Scope and description of the processing of personal data

Our website uses "Matomo" (formerly "Piwik"), a web analytics service provided by InnoCraft Ltd, 150 Willis St, 6011 Wellington, New Zealand. Matomo stores cookies on your end device, which enable an analysis of your use of our website. The information collected in this way is stored exclusively on our server, namely the following data:

  • two bytes of the IP address of the calling system of the user
  •  the called up web page
  • the website from which the user accessed the accessed website (referrer)
  • the subpages that are called from the called web page
  • the time spent on the website
  • the frequency of visiting the website

Our website uses Matomo with the setting "Anonymous Visitors' IP addresses". Thus IP addresses are processed in a shortened form, a direct personal relation is excluded. The software is set in such a way that the IP addresses are not stored completely, but 2 bytes of the IP address are masked (e.g. 192.168.xxx.xxx). In this way, it is no longer possible to assign the shortened IP address to the calling computer. The IP address transmitted by your browser via Matomo is not merged with other data collected by us.

Legal basis for the processing of personal data

The legal basis for the processing of the user's data is Art. 6 para. 1 lit. f DSGVO or § 15 para. 3 TMG.

Aims of the processing

With Matomo we analyze the use of our website and individual functions and offers in order to continuously improve the user experience. Through the statistical evaluation of user behavior we improve our offer and make it more interesting for visitors.

Duration of storage

The data of the processing described here will be deleted after a storage period of 90 days.

Possibility of objection and removal

You can prevent the evaluation by deleting existing cookies and deactivating the storage of cookies in the settings of your web browser. Please note that in this case you may not be able to use all functions of this website to their full extent.

We use the analysis tool of Hotjar Ldt. (Level 2, St Julian's Business Centre, 3, Elia Zammit Street, St JuliansSTJ1000, Malta; "Hotjar") on our website.The data processing serves the purpose of designing, optimizing and analyzing our website in line with requirements. The tool is used to randomly record the movements of site visitors on the website. This creates a log of mouse movements, scrolling behavior, dwell time and clicks on the website (so-called heat map).For this purpose, Hotjar uses cookies, among other things. The following information, among other things, may be collected: IP address (in anonymized form), information about the device you are using (screen size, devices, unique device identifier), information about the browser you are using, location data (only about the country), preferred language for displaying the website, operating system used. This function makes it possible to connect the advertising target groups generated with Google Analytics Remarketing with the functions of Google AdWords and Google DoubleClick, which work on all devices. This makes it possible to display interest-based customized advertising messages, depending on your prior usage and browsing patterns on a device (e.g. cell phone) in a manner tailored to you as well as on any of your devices (e.g. tablet or PC).

Google AdWords and Google Conversion Tracking

This website uses Google AdWords. AdWords is an online promotional program of Google Ireland Limited („Google“), Gordon House, Barrow Street, Dublin 4, Ireland.

In conjunction with Google AdWords, we use a tool called Conversion Tracking. If you click on an ad posted by Google, a cookie for Conversion Tracking purposes will be placed. Cookies are small text files the web browser places on the user’s computer. These cookies expire after 30 days and are not used to personally identify users. If the user visits certain pages of this website and the cookie has not yet expired, Google and we will be able to recognise that the user has clicked on an ad and has been linked to this page.

A different cookie is allocated to every Google AdWords customer. These cookies cannot be tracked via websites of AdWords customers. How do we use Klick-Tipp?

(1) In our online communication with you, we use the services of KLICK-TIPP LIMITED, 15 Cambridge Court, 210 Shepherd's Bush Road, London W6 7NJ, United Kingdom. The representative of KLICK-TIPP LIMITED within the meaning of Article 27 of the GDPR is Waterton Knowledge Center WKC UG, Friedrichstr. 53a, 15537 Erkner, Germany, represented by Ulf Castelle, DSGVO-Vertreter@klicktipp.com. We obtain these services through a main contractual relationship with Digistore24 GmbH, St.-Godehard-Straße 32, 31139 Hildesheim. Digistore24 is a reseller that procures products or services, such as Klick-Tipp, and sells them to buyers without significant further processing. With Klick-Tipp itself, we have additionally concluded an order processing in the sense of Article 28 DSGVO. This ensures that we have full control over the personal data processed there and that Klick-Tipp implements our instructions in a mirror image.

(2) We store your contact data at Klick-Tipp and, where applicable, process the data we process via the online marketing tools described in more detail in this privacy policy. This is because these providers are fully integrated with Klick-Tipp via a secure interface. Therefore, it is possible that Klick-Tipp takes note of this data, whereby - as already mentioned above - Klick-Tipp has no own right of use with regard to this data and is fully subject to our instructions.

(3) Furthermore, Klick-Tipp allows us to link your personal data with so-called tags. Klick-Tipp distinguishes between two types of tags:
SmartTags: when a contact registers via a registration form, he automatically receives a tag with the name of the registration form in question. Klick-Tipp also automatically sets the tags "Email received", "Email opened", "Email clicked" and "Email viewed in browser".
Manual tags: In addition to SmartTags, manual tags can be created. For example, you can tag contacts with the tag "Customer" or, more specifically, with the tag "Product B purchased".

5. Newsletter

Newsletter data

This website uses Newsletter2Go for the sending of newsletters. The provider is the Newsletter2Go GmbH, Nürnberger Straße 8, 10787 Berlin, Germany.

Newsletter2Go services can, among other things, be used to organize and analyse the sending of newsletters. The data you enter for the purpose of subscribing to the newsletter are archived on Newsletter2Go’s servers in Germany.

If you do not want to permit an analysis by Newsletter2Go, you must unsubscribe from the newsletter. We provide a link for you to do this in every newsletter message. Moreover, you can also unsubscribe from the newsletter right on the website.

Data analysis by Newsletter2Go

Newsletter2Go enables us to analyse our newsletter campaigns. For instance, it allows us to see whether a newsletter message has been opened and, if so, which links may have been clicked. This enables us to determine, which links drew an extraordinary number of clicks.

Moreover, we are also able to see whether once the e-mail was opened or a link was clicked, any previously defined actions were taken (conversion rate). This allows us to determine whether you have made a purchase after clicking on the newsletter.

Newsletter2Go also enables us to divide the subscribers to our newsletter into various categories (i.e. to „cluster“ recipients). For instance, newsletter recipients can be categorized based on age, gender or place of residence. This enables us to tailor our newsletter more effectively to the needs of the respective target groups.

Legal basis

Storage period

6. Plug-ins and Tools

YouTube with expanded data protection integration

Our website uses plug-ins of the YouTube platform, which is being operated by Google Ireland Limited („Google“), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in the expanded data protection mode. According to YouTube, this mode ensures that YouTube does not store any information about visitors to this website before they watch the video. Nevertheless, this does not necessarily mean that the sharing of data with YouTube partners can be ruled out as a result of the expanded data protection mode. For instance, regardless of whether you are watching a video, YouTube will always establish a connection with the Google DoubleClick network.

As soon as you start to play a YouTube video on our website, a connection to YouTube’s servers will be established. As a result, the YouTube server will be notified, which of our pages you have visited. If you are logged into your YouTube account while you visit our site, you enable YouTube to directly allocate your browsing patterns to your personal profile. You have the option to prevent this by logging out of your YouTube account.

Furthermore, after you have started to play a video, YouTube will be able to place various cookies on your device. With the assistance of these cookies, YouTube will be able to obtain information about our website visitor. Job Applications

We offer website visitors the opportunity to submit job applications to us (e.g. via e-mail, via postal services on by submitting the online job application form). Below, we will brief you on the scope, purpose and use of the personal data collected from you in conjunction with the application process. We assure you that the collection, processing and use of your data will occur in compliance with the applicable data privacy rights and all other statutory provisions and that your data will always be treated as strictly confidential. 

Scope and purpose of the collection of data

If you submit a job application to us, we will process any affiliated personal data (e.g. contact and communications data, application documents, notes taken during job interviews, etc.), if they are required to make a decision concerning the establishment or an employment relationship. The legal grounds for the aforementioned are § 26 New GDPR according to German Law (Negotiation of an Employment Relationship), Art. 6 Sect. 1 lit. b GDPR (General Contract Negotiations) and – provided you have given us your consent – Art. 6 Sect. 1 lit. a GDPR. You may revoke any consent given at any time. Within our company, your personal data will only be shared with individuals who are involved in the processing of your job application.

If your job application should result in your recruitment, the data you have submitted will be archived on the grounds of § 26 New GDPR and Art. 6 Sect. 1 lit. b GDPR for the purpose of implementing the employment relationship in our data processing system.

Data Archiving Period

If we should not be able to offer you a position, if you refuse a job offer, retract your application, revoke your consent to the processing of your data or ask us to delete your data, we will store your transferred data, incl. any physically submitted application documents for a maximum of 6 months after the conclusion of the application process (retention period) to enable us to track the details of the application process in the event of disparities (Art. 6 Sect. 1 lit. f GDPR).

YOU HAVE THE OPTION TO OBJECT TO THIS STORAGE/RETENTION OF YOUR DATA IF YOU HAVE LEGITIMATE INTERESTS TO DO SO THAT OUTWEIGH OUR INTERESTS.

Once the retention period has expired, the data will be deleted, unless we are subject to any other statutory retention obligations or if any other legal grounds exist to continue to store the data. If it should be foreseeable that the retention of your data will be necessary after the retention period has expired (e.g. due to imminent or pending litigation), the data shall not be deleted until the data have become irrelevant. This shall be without prejudice to any other statutory retention periods.

8. Our social media appearances

Data processing through social networks

We maintain publicly available profiles in social networks. The individual social networks we use can be found below.
Social networks such as Facebook, Google+ etc. can generally analyse your user behaviour comprehensively if you visit their website or a website with integrated social media content (e.g. like buttons or banner ads). When you visit our social media pages, numerous data protection-relevant processing operations are triggered.

In detail: If you are logged in to your social media account and visit our social media page, the operator of the social media portal can assign this visit to your user account. Under certain circumstances, your personal data may also be recorded if you are not logged in or do not have an account with the respective social media portal. In this case, this data is collected, for example, via cookies stored on your device or by recording your IP address.

Using the data collected in this way, the operators of the social media portals can create user profiles in which their preferences and interests are stored. This way you can see interest-based advertising inside and outside of your social media presence. If you have an account with the social network, interest-based advertising can be displayed on any device you are logged in to or have logged in to.

Please also note that we cannot retrace all processing operations on the social media portals. Depending on the provider, additional processing operations may therefore be carried out by the operators of the social media portals. Legal basis

Our social media appearances should ensure the widest possible presence on the Internet. This is a legitimate interest within the meaning of Art. 6 (1) lit. f GDPR. The analysis processes initiated by the social networks may be based on divergent legal bases to be specified by the operators of the social networks (e.g. consent within the meaning of Art. 6 (1) (a) GDPR).

Responsibility and assertion of rights

If you visit one of our social media sites (e.g., Facebook), we, together with the operator of the social media platform, are responsible for the data processing operations triggered during this visit. You can in principle protect your rights (information, correction, deletion, limitation of processing, data portability and complaint) vis-à-vis us as well as vis-à-vis the operator of the respective social media portal (e.g. Facebook).
Please note that despite the shared responsibility with the social media portal operators, we do not have full influence on the data processing operations of the social media portals. Our options are determined by the company policy of the respective provider.

Storage time

The data collected directly from us via the social media presence will be deleted from our systems as soon as the purpose for their storage lapses, you ask us to delete it, you revoke your consent to the storage or the purpose for the data storage lapses. Stored cookies remain on your device until you delete them. Mandatory statutory provisions – in particular, retention periods – remain unaffected.

We have no control over the storage duration of your data that are stored by the social network operators for their own purposes. For details, please contact the social network operators directly (e.g. in their privacy policy, see below).
